The Occupational Safety and Health Administration (OSHA) determined Jet Logistics Inc. (JLI) and New England Life Flight Inc. - doing business as Boston MedFlight (BMF) improperly terminated a pilot for complaining about what he reasonably believed were Federal Aviation Administration (FAA) related safety concerns.
Following an investigation, OSHA ordered the following:
1. Reinstatement of the pilot into his former job.
2. Removing any items relating to the issues that led to his termination.
3. That the employee be paid $133,616.09 in back wages and interest.
4. That the employee be paid $100,000.00 in compensatory damages.
5. That the employee be awarded reasonable attorney's fees.
6. That the employer refrain from retaliating against the employee in future.
7. That the employer post a whistleblower protection notice to all employees.
